Thanks to Obergefell v. Hodges, same-sex couples are now afforded the same rights to adoption as different-sex couples. This means a married same-sex couple can jointly adopt a child or children. It also means that same-sex couples can apply for step-parent adoption where one spouse has children from a prior relationship. Finally, some married same-sex couples are also taking the step of the non-biological spouse adopting children born during the marriage; a step being called “confirmation adoption.” Although it is not legally necessary, it is a protectionary measure being used.
